Terms of Use

1. Who we are

Vistory is operated by Ron Tabachnik, exempt dealer no. 211381702, trading as Digitab, 36 Golda Meir St., Netanya, Israel ("we", "us"). You can reach us at info@clinichub.co.il or 053-2919054.

Vistory is a standalone product by ClinicHub. You can use it on its own, or connect it to a ClinicHub account (section 8).

2. The service

Vistory is a visual documentation tool for professionals: clinics, practitioners, and beauty and aesthetics businesses. Among other things it lets you:

• take and upload before-and-after photos, organised by client, date, stage and angle
• browse a gallery, compare photos, and edit without altering the stored photo
• keep a Brand Kit (logo, colours and fonts) and create posts from photos in Social Studio
• export by download only

The service is meant for businesses and professionals, not private consumers. We keep developing Vistory, so we may add, change or remove features. We'll tell you in advance about a material change that affects you negatively.

3. Account, workspace and team

• Give accurate details when you sign up and keep them current. You must be 18 or older.
• You are responsible for keeping your password safe and for everything done under your account. Tell us right away if you think someone has used your account without permission.
• Work in Vistory happens inside a workspace that belongs to the business. Workspace owners invite team members, set their roles and can remove them.
• Photos and data belong to the workspace, meaning the business, not to the team member who took or uploaded them. A team member who leaves loses access; the documentation stays with the business.

4. Plans, payment and cancellation

• The Free plan includes 1 GB of storage and one user. Paid plans add storage and team seats: Pro with 10 GB, Team with 25 GB, and Enterprise by quote. The exact price is shown before you buy.
• A ClinicHub Pro subscription includes Vistory Pro at no extra cost.
• Payment goes through ClinicHub's billing system, with secure card processing by Cardcom. We don't store card numbers.
• Subscriptions renew automatically at the end of each period (monthly or yearly) until cancelled. You can cancel renewal at any time from the Plan screen, and the plan keeps working until the end of the paid period.
• You may cancel a purchase within 14 days for a full refund, under Israel's Consumer Protection Law, 1981. The cancellation rights the law gives small businesses also apply.
• A price change applies to an existing subscription only from its next renewal, with advance notice.
• Ending a subscription or moving to a smaller plan never deletes photos. If you use more than the new plan's storage, you can't upload new photos until there is room, but everything already stored stays available to view, download and delete.

5. Storage and upload limits

• Storage is measured per workspace. We warn you at 70%, 85% and 95% of your quota. At 100%, uploads stop until space is freed or the plan is upgraded.
• JPEG, PNG, WebP and HEIC/HEIF files are supported, up to 25 MB per photo. Video is not supported yet.
• Every photo is decoded and re-encoded on the server. We keep a JPEG of up to 4096 pixels on the long edge, plus a smaller preview. The original uploaded file, with its EXIF and location data, is not kept.
• Edits are saved as a recipe applied to the photo, so the stored photo never changes.
• To protect the service we apply rate limits and reasonable-use limits. Sustained heavy overuse may lead to throttling or to us getting in touch.

6. Client photos and consent

This is your most important responsibility as a Vistory user:

• Getting the client's explicit, informed consent to be photographed, before the photo is taken, is solely the business's responsibility. Vistory lets you record the consent status, but it does not check or verify that consent was given.
• Consent to be photographed is not consent to publish. Using a photo outside the client's file, for example on social media, a website or in an ad, requires separate, explicit consent to marketing use.
• Photographing a minor requires the consent of a parent or guardian.
• A photo documenting a treatment may be part of the client's medical record. Any legal duty to keep records that applies to you, such as keeping them for at least 7 years under Israel's Patient's Rights Law, 1996, remains the business's responsibility, including when a photo is deleted in Vistory.
• Don't upload a photo of a person who hasn't consented, or a photo unrelated to documenting the service they received.

7. Social Studio and exports

• Vistory has no public share links. All photos are private, and the only way to take a photo or post out of Vistory is to download it.
• Once you download a file it is outside Vistory's control, and keeping it safe and using it properly is your responsibility.
• You are responsible for what you publish, including the client's consent to marketing use (section 6), following the rules of the platform you publish on, and not misleading anyone, for example with edits that change how a treatment result looks.
• Templates, fonts and design elements provided in Vistory may be used in posts you create for your own business.

8. Connecting ClinicHub

• Connecting ClinicHub is optional, and happens only after you approve it on ClinicHub's consent screen.
• Once connected, Vistory reads clients, appointments, services and professionals from ClinicHub so that documentation follows your treatments. If you approved it, Vistory can also add a new client to ClinicHub. Vistory never changes or deletes anything in ClinicHub.
• Photos documented in Vistory and linked to a client appear in that client's file in ClinicHub, read-only, and only to people allowed to open that client.
• You can disconnect at any time. Photos and data already in Vistory stay there.

9. Who owns the data

Photos, client details and everything else the business uploads to Vistory belong to the business. We acquire no rights in them and act as a data processor on the business's behalf. We use the content only to provide the service: not to train AI models, not for research, not for marketing, and never for sale to third parties.

You grant us a limited licence to store, process and display the content only as far as needed to provide the service to you and your team.

10. Prohibited use

You may not:

• use Vistory for any unlawful purpose
• upload offensive or misleading content, or content that infringes someone else's rights, including copyright and privacy
• get around storage limits or permissions, or use the storage for anything other than documenting services to the business's clients
• try to break into, disrupt, scan or overload the service, or access it by automated means we haven't provided for that
• sell, rent or hand over access to your account to others

If an account breaches these terms we may suspend or close it. Where possible we'll give notice first and let you download your photos.

11. Intellectual property

All rights in Vistory, including its code, design, name, logo and templates, belong to the operator. Don't copy or reproduce them, or use them outside the service, without written permission.

12. Availability and liability

• We work to keep Vistory available and secure, but the service is provided "as is", and we don't promise it will run without interruption or error.
• Vistory is a documentation tool. It doesn't replace professional or medical judgement, and it isn't responsible for the treatment a business gives its clients.
• To the extent the law allows, we are not liable for indirect, consequential or special damage, including lost profits or data. Our total liability is limited to what you paid for Vistory in the 12 months before the event.
• We recommend downloading a copy of documentation that matters to you from time to time.

13. Closing your account and deletion

• You can stop using Vistory at any time, and ask us to close your workspace.
• A deleted session can be restored for 30 days from Recently deleted. Deleted photos are permanently removed from storage within 30 days, and after that they cannot be recovered.
• Before closing a workspace, download everything you need to keep, especially photos the law requires you to keep (section 6).

14. Changes to these terms

We may update these terms from time to time. We'll give at least 7 days' notice of a material change, by email or in the service. Continuing to use Vistory after the change takes effect means you accept the updated terms.

15. Governing law

These terms are governed solely by Israeli law. The competent courts in Israel have exclusive jurisdiction.
